These terms of service govern your use of the Pako Festa Online Ordering System, a project by the Geelong Ethnic Communities Council (GECC), trading as Diversitat. References to the "website" include; www.pakofesta.com.au, bookings.pakofesta.com.au or any other site, services (including web services), software, applications or media managed and governed by the Geelong Ethnic Communities Council (GECC). "You" and "Your" means the person using the website to order goods and subject to these terms of service. Pako Festa, "We", "Us", or "Our" means; Pako Festa, a project of the Geelong Ethnic Communities Council (GECC) trading as Diversitat, ABN 29 252 806 279. Your access to, and use of, this website constitutes your agreement to all such terms of service. In using the website you affirm that you are 18 years or older, or possess legal parental or guardian consent, and are fully able and competent to give the undertakings set out in these terms of service, and to abide by and comply with these terms of service. We reserve the right to amend these terms of service at any time so we recommend that you check these terms of service regularly. If you do not agree with the terms of service, do not use the website. This Website is owned and operated by Geelong Ethnic Communities Council (GECC), trading as Diversitat.
Order Confirmation
Your order is not confirmed until full payment is received via Visa, Mastercard or another card that Pako Festa may accept at its sole discretion. Any time or items that you may have selected will not be confirmed until payment is received. All times and available items will be available on a first come, first serve basis and you are responsible for confirming your order as soon as possible to avoid missing out.
Collection of Orders
To collect your confirmed order, you must arrive at the designated location at the designated time on 27 February 2021. Your order will not be available at any other location or at any other time. The location, address and designated time will be made clear in both the confirmation email and on the order confirmation screen.
When collecting your order, you must be able to provide your order reference, a series of seven letters and numbers associated with your order starting with T or D and the name associated with your order.
Pako Festa suggests printing both the order confirmation email and the order confirmation screen and bringing these items with you.
Pako Festa reserves the right to ask for identification to verify that your identity matches the name on the order. Only the person named on the order will be able to collect the order.
Late Collection
Times are carefully limited for COVID Safe purposes. You must arrive at the designated time to collect your order. Failure to arrive at the specified location within 15 minutes of your designated time may result in Pako Festa cancelling your order. No refund will be available in such a circumstance.
Takeaway or Dine-In
If you have selected takeaway for your order (the first letter of your order reference is T), dine-in facilities will not be provided and you will be required to take and consume your order off-site.
If you have selected dine-in for your order (the first letter of your order reference is D), dine-in facilities will be provided subject to restrictions imposed by the government.
Dine-in facilities can only be provided for the total number of people that you have specified will be attending. Your order confirmation email and the order confirmation screen will specify the total number of people who can attend. If additional people attend to the number that you have specified they will not be admitted to the venue and will be required to leave for COVID Safe reasons.
Dine-in facilities will only be available for 90 minutes after the designated order time. After this time, you will be required to leave the venue to allow for cleaning and sanitisation for the next arriving orders.
Restriction Changes
In the event that circumstances beyond the control of Pako Festa, including but not limited to changes to government restrictions, require the cancellation of dine-in facilities, any dine-in orders (the first letter of your order reference is D) will automatically become takeaway orders.
In this event, dine-in facilities will not be provided and all orders will be required to be taken off-site for consumption.
Weather
In the event of inclement weather any dine-in orders (the first letter of your order reference is D) at venues with outdoor dining will automatically become takeaway orders at Pako Festa's sole discretion.

Licenced Venues
Some venues may be licenced, which will permit the purchase and consumption of alcohol by adults at the venue. You must follow the directions of posted venue signs and staff at all times where applicable.
Minimum Age
You must be 18 years or older to place an order. Children count towards the maximum number of attendees in your order, and must be supervised by an adult at all times.
Staff Directions
When attending any Pako Festa venue you must follow all lawful directions by Pako Festa event staff at all times. This includes COVID Marshalls. Directions may include, but will not be limited to the requirement to wear a mask or face covering and to observe social distancing.
Pako Festa reserves the right to expel any person from a venue for failing to comply with lawful directions given by event staff.
Prices
All prices on the Pako Festa website are in Australian Dollars (AUD) and include GST where required. All charges to your nominated card will be in Australian Dollars (AUD).
Confirmation Email
Circumstances beyond Pako Festa’s control, including but not limited to an invalid email address being supplied upon ordering could lead to a confirmation email not being received.
Pako Festa suggests that you print the order confirmation screen in addition to the email and is not responsible for confirmation emails not being received.
Correct Information
You are required to provide correct information at the time of ordering. Failure to provide correct information may lead to the inability to collect your order or order cancellation.
Refunds will not be available in the event that incorrect information is supplied.
Cancellations and Refunds
Pako Festa advises you to choose your order items, location and time carefully as all sales are final and cancellations and refunds will not be available in most cases.
In rare cases that a refund is available (such as an ordered item becoming unavailable, accidental overbooking of a designated time or other circumstances at the sole discretion of Pako Festa), refunds will be processed back to the card used for the original payment. Cash refunds will not be available.
Availability of Items
The website may present a list of choices associated with each menu item, such as soft drinks where a number of varieties will be offered. You will be invited to choose from a number of choices when collecting your order. Some of the listed choices may not be available due circumstances beyond Pako Festa’s control, including but not limited to items selling out prior to your designated time. You will be able to choose from remaining options.
If a menu item becomes unavailable due to circumstances beyond Pako Festa’s control, Pako Festa will attempt to substitute your ordered item with a replacement of similar value. If this is not possible, or the replacement is not satisfactory then you will be eligible for a refund to the value of that particular item.
Time Availability
In rare cases, including but not limited to accidental overbooking, the specified time on your order may become unavailable. In this circumstance, Pako Festa will attempt to find an alternative suitable time as close to your originally booked time as possible.
Should this not be possible or if the new time is not satisfactory to you, a refund will be provided and your order will be cancelled.
Allergens
Pako Festa cannot guarantee that any item is free from any food allergens, including but not limited to gluten, nuts, dairy or any other food ingredient or additive.
